Heard learned counsel for the petitioner.
The writ petition arises out of the proceedings under Section 67 of the U.P. Revenue Code wherein the petitioner has been ordered to be evicted from 70 Sq.M. of plot no.435 which is stated to be recorded as a pond.
The contention of the counsel for the petitioner is that he is residing in his house on no.428 and 430. He was never in possession of any portion of plot no.435.
In view of the submission made and since the petitioner cannot be disposses from a plot he is not in possession of, the order of eviction class for no interference.
The writ petition can be entertained only on the question of quantum of damages imposed upon the petitioner.
Since only a meagre sum of Rs.1800/- has been imposed as damages, this Court does not consider is expedient to interfere.
Petitioner may deposit the meagre damages imposed.
Subject to the above, this writ petition stands disposed of. Order Date :- 29.11.2019 C. MANI
