Case called out in the revised list. None is present on behalf of the revisionist to press this revision. No one is present on behalf of the opposite party No. 2 also. Learned A.G.A. is present on behalf of the opposite party No.1.
I have heard learned A.G.A. for the State and perused the record.
This criminal revision has been preferred by the revisionist against the order dated 21.2.1992 passed by Sessions Judge Rampur in Criminal Revision No. 101 of 1991 setting asise the order dated 27.05.1991 passed by C.J.M., Rampur, whereby bail application of the revisionist was rejected on the ground that learned C.J.M. Rampur had no jurisdiction to hear the matter as the investigation of the case was transferred to E.O.W. Record reveals that order dated 27.05.1991 was assailed by the opposite party no.2 before the Sessions Judge, Rampur, which was allowed setting aside the order of C.J.M., Rampur remanding the matter for fresh consideration and disposing of the surrender and bail application of the revisionist in the light of the observations made in the order dated 21.02.1992 which has been challenged in the present revision by the revisionist.
It is contended by learned A.G.A. for the State that the present revision is not maintainable against the order dated 21.02.1992 and has not yet been admitted.
After having heard learned AGA and perusing the material on record as well as finding recorded by the Sessions Judge, Rampur in the order order 21.02.1992, I do not find any manifest error of law or illegality in the order dated 21.02.1992. Reasons given by the Sessions Judge in the order dated 21.2.1992 are sound reasons and not liable to be interfered. Hence, the present revision lacks merit and is accordingly dismissed.
