By means of the present petition the petitioner is seeking for quashing for the first information report dated 06.09.2021 in Case Crime No.0198 of 2021 under Sections 420, 406, 504, 506 IPC, Police Station Kotwali Nagar, District Saharanpur.
The allegations in the first information report regarding commission of a cognizable offence are clear and categorical. The contention of the learned counsel for the petitioner is that the petitioner and the complainant/respondent No.3 had business relation and a complaint under Section 138 of Negotiable Instrument Act' 1881 has already been filed by the complainant wherein proceedings are pending before the competent court.
These submissions of learned counsel for the petitioner do not have any bearing on the merits of the case, in as much as, for the allegations of fraud lodged in the first information report investigation has to be concluded. Any interference at this stage may impede the speedy investigation. No case is made out for interference.
The writ petition is, accordingly, dismissed.
