The sole relief pressed for by the learned counsel for the petitioners at the time of hearing of the writ petition is that the application filed by the petitioners under Section 3H(3) of the National Highways Act, 1956 for apportionment of the compensation be decided.
Learned Additional Solicitor General of India has accepted notice on behalf of respondent No.1 while Sri Devendra Kumar has accepted notice on behalf of the National Highways Authority of India. Learned Standing Counsel appears for respondent No.3. Learned counsel for the respondents state that a decision shall be taken on the application filed by the petitioners at an early date.
The Writ Petition is, accordingly, disposed of with a direction to the Competent Authority to decide the application filed by the petitioners after hearing the parties concerned including the other persons to whom compensation is to be paid expeditiously and preferably within a period of three months from the date a certified copy of the order is passed.
It is made clear that the Court has not adjudicated on the merits of the case and, it would be for the Competent Authority to decide the application in accordance with law.
