The petitioner was the fair price shop dealer of village panchayat Majhgawan, District-Bareilly. The fair price shop licence of the petitioner was cancelled by order dated 16.2.2018. The petitioner took the order of cancellation in appeal before the appellate authority. The appeal was registered as Appeal No.76 of 2018 before the respondent No.2.
The only prayer made by Shri S.M. Khalid, learned counsel for the petitioner is that the appeal may be decided expeditiously within a stipulated time frame.
Learned Standing Counsel has no serious objection to the aforesaid prayer being granted.
No useful purpose will be served by keeping the writ petition pending. With consent of the parties, the writ petition is being finally disposed of.
The respondent No.2 or any other competent authority, before whom the appeal is pending, shall decide the appeal on merits within a period of three months from the submission of a certified copy of this order. It is further provided that in the light of law laid down by the Hob'ble Supreme Court in the case of Poonam Vs. State of U.P. and others reported 2016(7) ADJ 530, any alternative arrangement made for distribution of essential commodities or any fresh appointment made to effectuate such purpose will abide by the decision of the appeal.
With the aforesaid direction, the writ petition is disposed of.
