Heard learned counsel for the petitioner, learned Standing Counsel for the State Authorities and Sri Ankit Sharan, learned counsel for the electricity department.
The petitioner is a consumer of electricity department having domestic connection. It is submitted that there were certain defaults in payment of bill and, therefore, now a recovery certificate has been issued to the tune of Rs. 3,56,069/-.
Learned counsel for the petitioner submits that for settlement of dues the petitioner was allowed to register under OTS (Amnesty Scheme) by depositing an amount of Rs. 1,000/- on 4.5.2017 and thereafter, the petitioner has deposited an amount of Rs. 50,000/- on 14.6.2017. Thereafter, no further settlement has been arrived at between the petitioner and electricity department under the alleged OTS (Amnesty Scheme).
Upon query being made under which provision OTS (Amnesty Scheme) provides for settlement of electricity dues under the Electricity Code or Act, no provision has been shown to the Court.
In our view, it would be appropriate to direct the Executive Engineer, respondent no. 4, to look into the matter and pass appropriate order in accordance with law upon representation being made by the petitioner, as far as possible, within a period of one month from the date a certified copy of this order is filed before the respondent no. 4.
For a period of one month, no coercive action shall be taken against the petitioner pursuant to the recovery certificate dated 3.2.2018.
With the aforesaid observations/ directions, the writ petition is disposed of.
