Heard learned counsel for the parties.
Petitioner, a Constable in Civil Police, posted at Agra, was transferred by the impugned order dated 12 July 2019, to G.R.P., Lucknow.
It is urged that the petitioner had earlier worked with G.R.P. between 2008-2012. In the circumstances, it is submitted that the petitioner cannot be reposted at G.R.P. in view of the circular dated 6 April 2017. It is urged that S.S.P., Agra vide communication dated 1 August 2019, has made a recommendation, which is pending before the second respondent-Additional Director General of Police, Lucknow.
Learned Senior Counsel confines the writ petition to the prayer clause 'b', which reads thus:
i) issue a writ, order or direction in the nature of mandamus directing the respondent no. 2, to pass appropriate order on the recommendation of the SSP, Agra, dated 01.08.2019, for cancelling the transfer order of the petitioner.
Learned Standing Counsel submits that the second respondent-Additional Director General of Police, Lucknow, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the second respondent-Additional Director General of Police, Lucknow, to consider and decide the application of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
