Heard learned counsel for the petitioner, learned Standing Counsel for respondents no.1, 2 & 4 and Sri Shravan Kumar Panday. learned counsel for the respondent no.3.
The petitioner pursuant to the advertisement dated 03.06.2019 appeared in the examination for selection of Assistant Teacher in English Medium School run by the Basic Education Board. The petitioner qualified in the written examination and thereafter appeared in the interview. The petitioner has been selected on the basis of marks obtained in written examination as well as interview and the name of the petitioner appeared at serial no. 29 in the merit list.
In the counselling, the petitioner was allotted Prathmik Vidyalaya, Madhawapur (English Medium), Block Sahar, District Auraiya which is not first preference of the petitioner opted by the petitioner. According to the petitioner, several other persons who have secured lesser marks than the petitioner have been allotted the District of their preference. The petitioner has submitted a representation to the District Basic Education Officer, District Auraiya to allot the School to the petitioner as per the merit list, a copy of the representation is enclosed as Annexure-7 to the writ petition.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending, and an appropriate direction be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case, without going into merits of the case and with the consent of the parties, the writ petition is disposed of with direction to the petitioner to file a fresh representation before the respondent no.3/District Basic Education Officer, Auraiya raising all his grievances within a period of 15 days from today. In case any such representation is filed, the respondent no.3 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
With the aforesaid observations, the writ petition is disposed off.
