Heard learned counsel for the applicant and learned A.G.A for the State as also perused the record.
This application under Section 482 Cr.P.C. has been filed to quash the order dated 11.12.2017 passed by the Addl. Sessions Judge, Court No. 10, Kanpur Nagar as well as entire proceedings of S.T No. 436 of 2003 (State Vs. V.P. Singh & others), arising out of Case Crime No. 80 of 1999, under Sections- 147, 148, 323, 436 I.P.C., Police Station- Gawaltoli, District- Kanpur Nagar.
Admittedly, in the Session Trial No. 436 of 2003, arising out of Case Crime No. 80 of 1999, the applicant was enlarged on bail on 22.05.1999.
As noted above, the case is sufficiently old though charges have been framed recently on 11.12.2017. While, learned counsel for the applicant submits that no case is made out against the applicant, at the same time, it is seen that the trial has remained pending for very long.
Considering the fact that the trial has remained pending for very long and without expressing any opinion on the merits of the case, this application is finally disposed of with a direction to the court below to decide the aforesaid case in accordance with law, as expeditiously as possible, preferably within a period of one year from the date of production of a certified copy of this order, if there is no other legal impediment.
