Petitioner's grievance is that his claim pursuant to the advertisement has not been considered for appointment to the post of Assistant Teacher. It is stated that respondents are illegally shuffling the candidates and even though he was initially called in the first counselling, but while conducting second counselling, his claim has been ignored.
Sri Awadhesh Kumar appearing for the respondents points out that petitioner's quality point mark is 64.99, whereas the last person called for interview has above 67.24 quality point marks. It is contended that no person having lower merit than petitioner has been considered for the purpose.
So far as the petitioner's grievance with regard to reshuffling etc. are concerned, the same need not be entertained, inasmuch as none of the selected persons is before this Court.
In view of the statement of the respondents, it otherwise appears that no person lower in merit to petitioner has been considered. In such circumstances, petitioner can have no grievance in the matter relating to non-consideration of his claim.
Writ petition is, accordingly, dismissed.
It is, however, provided that in case the merit drops any further and petitioner becomes eligible, his candidature shall be considered, in accordance with law.
