The instant petition under Article 227 of the Constitution has been filed seeking a direction to Judge Small Cause, Bareilly, before whom SCC Suit No. 35/2015 is pending to decide the same within stipulated time.
The suit has been instituted by the petitioner for recovery of arrears of rent and for ejectment of respondent No. 2. The petitioner has filed an application under Order 6 Rule 17 CPC seeking amendment in the plaint thereby impleading respondent No. 3 as one of the defendants. The said application, it appears, is still pending for consideration before the trial Court. In such circumstances, this Court is not inclined to issue any direction at this stage, but leaves it open to the petitioner to make a request to the trial Court to commence the trial of the suit expeditiously, as soon as the pleadings are complete and in which event, the trial Court shall make endeavour to conclude the proceedings expeditiously, without granting unnecessary adjournments to the parties.
The petition stands disposed of with the above directions.
