Petitioner is seeking employment in the Indian Railway. A Indian Railways is already notified under Section 14 of the Administrative Tribunals Act, 1985 learned counsel for the respondent contends that in respect of the cause, which has given rise to filing of the present petition before this Court, petitioners have the remedy of approaching Central Administrative Tribunal and in view of the law laid down by the Apex Court in L. Chandra Kumar Vs. Union of India, (1997) 3 SCC 261, this petition is not liable to be entertained, directly.
This Court finds substance in the objection raised on behalf of the respondents, inasmuch as in respect of the cause of action, which has arisen to the petitioners, their remedy would be to approach the Central Administrative Tribunal, at the first instance.
Leaving it open to the petitioner to approach the Central Administrative Tribunal for redressal of their grievance, this petition is consigned to record.
