Petition under Section 438 Cr.P.C. 2. According to the petitioner, he is apprehending arrest in connection with Crime No.659/2011 of the Town Police Station, Kozhikode. It seems that the petitioner had earlier approached this Court, through Crl.M.C. No.1939 of 2012 for getting the proceedings in the crime quashed. The said Crl.M.C. was dismissed by this Court, through order dated 21.1.2014.

At the same time, in the said order, this Court had observed “it is made clear that in case the petitioner surrenders before the learned Magistrate and files an application for bail, learned Magistrate shall consider the matter on merits and dispose of the application on the date of its filing in accordance with law”.
B.A.6347 of 2014 2 Based on the very same observations, I am of the view that this bail application can be disposed of.
In the result, this bail application is disposed of, by endorsing the above said observations of this Court, mentioned in order dated 21.1.2014 in Crl.M.C. No.1935 of 2014.
