This bail application has been moved on behalf of the applicant accused- Sanjeev Kumar Kashyap, who is involved in Case Crime No. 322 of 2009, Under Section 406, 411 IPC, Police Station- Sadar Bazar, District- Shahjahanpur.
Heard learned counsel for the applicant, learned AGA and perused the record.
It is contended by the learned counsel for the applicant that the offence is triable by the Magistrate and the applicant is in jail for about 1 and 1/2 years. Co accused Ram Kishor, has been granted bail by this court on 23.12.2009 in Cr. Misc. Bail Application No. 35203 of 2009, copy of his bail order is produced before the court. It is argued by the learned counsel for the applicant that the case of the applicant accused is on similar footing, therefore, applicant is entitled for bail.
Learned AGA opposed the bail application, however, fairly conceded that co-accused has already been released on bail.
Considering the submissions of learned counsel for the applicant, totality of facts and circumstances of the case and without expressing any opinion on the merits of the case, I consider it a fit case for bail.
Let the applicant- Sanjeev Kumar Kashyap involved in the aforesaid case crime be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of the Court concerned.
