The petitioners are aggrieved by the realization of additional fee under Rules 32 and 81 of the Central Motor Vehicle Rules, 1989 as amended vide notification No.G.S.R. dated 29.12.2016 which has not been implemented in the State of U.P. as per the order of the Transport Commissioner dated 29th April, 2019.
Learned counsel for the petitioners presses that the matter may be heard on merits as regards the validity of the notification dated 29.12.2016.
Learned Standing Counsel as well as Sri R.K. Jaiswal, learned Counsel for the Union of India may file counter affidavit within six weeks.
