Heard learned counsel for the applicant, learned AGA and perused the record.
The instant application under section 482 Cr.P.C., has been filed for quashing the impugned order dated 24.07.2018 passed by the Special Chief Judicial Magistrate, Varanasi in Case Crime No. 736 of 2017, under sections 41, 411, 414, 419 and 420 IPC, P.S. Bhelupur, District Varanasi.
It is contended by the learned counsel for the applicant that application dated 25.04.2018 was filed by the applicant for remission of the article and requisite cash from the III-Additional Chief Judicial Magistrate, Varanasi to police of P.S. Park Street, Kolkata for further investigation for re- seizure whereupon vide order 24.07.2018 the Special Chief Judicial Magistrate, Varanasi it was directed to the District Magistrate, Varanasi to supervise the matter under his control keeping in touch with all the concerned departments and submit his report within two months.
The matter is lingering since long, therefore, the concerned authorities are directed to effectively consider and dispose off the application dated 25.04.2018 of the applicant strictly within the stipulated time, as per order dated 24.07.2018 passed by the the Special Chief Judicial Magistrate, Varanasi.
With the aforesaid direction, the application under section 482 Cr.P.C., is finally disposed off.
