Learned Standing Counsel has forwarded a copy of instructions received from respondent No.3. It is stated therein that due to paucity of funds, the payment has not been made to the petitioner and for release of fund but communications are being made with the government regularly.
We fail to understand as to when the funds are not available, how the work of contract is executed and contractor is made to work. Since, the respondents do not dispute the claim of the petitioner and admit that amount being claimed is due, we hereby allowed the writ petition and issue a writ of mandamus commanding the respondents to ensure payment of total outstanding dues to the petitioner within a period of one month from the date of production of certified copy of this order alongwith 9% simple interest on the delayed payment, which shall be calculated from the date the payment become due and till actual payment is made.
