Heard learned counsel for the petitioner, learned AGA for the State-respondents and perused the records.
By means of present writ petition, the petitioner is seeking quashing of FIR dated 30.12.2020, registered as Case Crime No. 181 of 2020, under Sections 419, 420, 467, 468, 471, 406, 323, 504, 506 IPC and Section 3 (1) (Da), 3 (1) (Gha) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amendment, 2015), Police Station Mail District Deoria.
It is contended by the learned counsel for the petitioner that the allegations in the FIR are false and based on concocted story. The occurrence is of the year 2015 and the transaction of money between the petitioner and first informant, as per FIR, took place between 15.01.2015 to 31.12.2015.
The facts of the matter is that the petitioner and the first informant were close friend and business partner, as they were property dealer. The transaction of money took place between them during continuance of the said business.
Considering the submission made by the learned counsel for the petitioner and the material on record, though we do not find any reason to quash the First Information Report but for the assertions made herein, it is provided that the petitioner shall not be arrested pursuant to the aforesaid First Information Report, till submission of the police report under Section 173(2) Cr.P.C. He shall, however, cooperate in the investigation and shall not make any effort to influence any witnesses or tamper any evidence.
The writ petition is, accordingly, disposed of.
