Heard Mr.A.S.Asthavadi, learned advocate for the petitioner. It is submitted that while deciding the application at Ex.7 filed by the petitioner raising a preliminary issue regarding maintainability of the Approval Application, the Tribunal has passed an order on 03.04.2006, wherein it has been stated that the issue regarding maintainability of the Approval Application shall be decided at the time of deciding the main Approval Application. It is further submitted that the issue regarding maintainability of the Approval Application has not been decided while passing the impugned order dated 29.03.2012, and no issue regarding maintainability has been framed.
