By means of the present petition, the petitioner herein seeks for quashing of the First Information Report dated 20.02.2021 registered as Case Crime No.0026 of 2021 under Sections 3(1) of U.P. Gangster & Anti Social Activities (Prevention) Act 1986 P.S-Ranipur District-Mau.
Seeking for quashing of the first information report, it is contended that the petitioner herein is a poor and innocent person. In the criminal cases which had been lodged against him in the year, 2018, the petitioner has been granted bail by the competent court.
Considering the above, we may note that the allegations in the first information report are to the effect that the petitioner was a member of gang who had indulged in anti social activities within the meaning of Section 3(1) of the Act, 1986.
The release of the petitioner on bail in criminal cases lodged under the Excise Act has no bearing on the allegations herein.
Any interference at this stage may impede the speedy investigation.
The writ petition is found devoid of merit and hence dismissed. Order Date :- 23.9.2021 Harshita
