Heard learned counsel for the applicant and learned A.G.A. for the State and perused the material placed on record.
It is submitted by learned counsel for the applicant that the applicant is first informant in the case. The trial is lingering on for past more than one yearss which may be directed to be concluded as early as possible.It is next submitted that all the accused have been enlarged on bail. Learned counsel for the applicant states that he has no instruction as to whether charges against the accused have been framed in the matter or not.
Be that as it may, without expressing any opinion on the merits of the applicant's case, this application U/s 482 Cr.P.C. is finally disposed of with a direction to the court concerned to decide Sessions Trial No. 269 of 2020 (State vs.Kashi Yadav and others) arising out of Case Crime No.13 of 2020 under Sections 147, 148, 323, 302, 452, 504 and 506 I.P.C., Police Station Nautanwa, District Maharajganj, pending in the court of Sessions Judge,Maharajganj in accordance with law without granting unnecessary adjournments to either of the parties as expeditiously as possible. The trial court is further directed to take stern, strict and coercive measures to secure and procure their presence before it, if the accused are adopting dilatory tactics to delay the trial.
