Heard Mr. Sandeep Kumar Tripathi, learned counsel for the applicant and Mr. Sunil Kumar Mishra, learned counsel for opposite party No. 2 and learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed for quashing of the charge sheet dated 20.4.2020 and entire proceedings of Criminal Case No. 1305 of 2020 (State vs. Sanjay and others) arising out of Case Crime No. 0004 of 2020, under Sections 498-A, 323, 504, 506 IPC and 3/4 D.P. Act, police station Mahila Thana, district Rampur.
Learned counsel for the parties jointly submits that the matter is likely to be compromised between the applicant No.1 and opp. party No.2 as the dispute between the parties is matrimonial in nature.
In view of the aforesaid submissions, let the matter be placed before the Mediating Agency at District Rampur, where the present case is pending.
The applicant is directed to deposit Rs.15,000/- to the Mediating Agency at District Rampur within three weeks from today, out of which Rs.14,000/- shall be paid to opp. party No.2 for appearance before the Mediation Centre and Rs. 1,000/- shall go the District Mediating Agency.
It is further directed that the Mediating Agency at District Rampur shall conclude the mediation and conciliation proceedings preferably within a period of two months from the date of appearance of the parties after giving notices to both the parties.
For a period of two months from today, no coercive action shall be taken against the applicants in the above mentioned case.
In case the aforesaid amount is not deposited within the aforesaid period, the trial court is at liberty to proceed against the applicants in accordance with law.
With the aforesaid observations, the application stands disposed of.
