Heard learned counsel for the petitioners; learned A.G.A. for the respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the first information report dated 21.12.2020 registered as Case Crime No.948 of 2020, under Sections 363, 366, 504, 506, 376 IPC, P.S.
Pipraich, District Gorakhpur.
The allegation in the impugned first information report, which has been lodged by the father of the victim Reena, is to the effect that Reena, who is a minor, was enticed away and was exploited in the State of Nepal.
On 25.03.2021, learned A.G.A. was required to file statement of the victim recorded under Section 164 Cr.P.C.
Learned A.G.A. has filed a short counter affidavit enclosing therewith the statement of the victim. From her statement, it appears that she was minor when taken from home to Nepal where she was sold for Rs.2 lac.
Under the circumstances, this appears to be a case of human trafficking hence the prayer of the petitioner to quash the first information report cannot be accepted.
The petition is dismissed.
