Heard Shri Vishal Agarwal, Advocate appeared on behalf of opposite party nos. 2 and 3 and filed a short counter affidavit along with his Vakalatnama which is taken on record.
Heard Shri Pramod Kumar Dwivedi, learned counsel for the applicants, learned AGA for the State, Shri Vishal Agarwal, learned counsel for opposite party nos. 2 and 3 and perused the record.
It is contended by learned counsel for the parties that present dispute is an off shoot of matrimonial dispute between applicant no. 1 and opposite party no. 3, which they have amicably resolved by way of compromise. It is further contended that pursuant to compromise arrived at, both applicant no. 1 and opposite party no. 3 are happily living together and now no dispute remains between them. It is further contended that in terms of compromise arrived at, opposite party no. 2 and 3 do not wish to contest the criminal case against applicants, proceedings of the case may be quashed.
Considering that present dispute is an off shoot of a matrimonial dispute and parties have entered into compromise and in pursuance there of both applicant no. 1 and opposite party no. 3 have started living together happily and now no dispute remains between them, proceedings of the criminal case are liable to be quashed.
Accordingly, application is allowed.
Proceedings of Case No. 689 of 2011, under sections 498-A, 323 I.P.C. read with section 3/4 of Dowry Prohibition Act, Police Station Chharra, District Aligarh, pending in the court of Additional Chief Judicial Magistrate, Court no. 6, Aligarh are quashed.
