Heard learned counsel for the applicant and the learned AGA for the State.
The submission is that the order for recovery of arrears of maintenance amount, amounting to Rs.1,58,000/- were passed on 13.10.2018. The applicant has neither paid the aforesaid amount nor has appeared before the Court below. He has approached this Court against the order dated 27.11.2017 issuing non-bailable warrants passed by Court and and has prayed for recall it the recovery warrant / non bailable warrant. It has been submitted that the order passed by the Family Court under Section 125 Cr.P.C has become final. No further proceedings have been initiated by the applicant.
This application is disposed of granting six months time to the applicant for depositing the aforesaid amount in six equal instalments. The recovery proceedings against the applicant shall remain stayed from the date of depositing of the first instalment.
In case applicant fails to comply with this order, the recovery proceedings against the applicant shall be revived and taken into its logical conclusion.
