The instant contempt application has been filed for alleged violation of direction issued by this Court on 10.08.2017 in Writ-C No. 35668 of 2017 directing disposal of application of the applicants under Section 28-A of the Land Acquisition Act within four months from the date of receipt of certified copy of the order.
Counsel for the applicants submitted that certified copy of the order of the Writ Court alongwith the application under Section 28-A dated 23.10.2017 were filed in the office of opposite party on the same date followed by various reminders, but no decision has been taken in the matter so far.
Counsel for the applicants placed on record certified copy of application filed by the applicants for being issued order sheet of the case and upon which an endorsement has been made by the office of Special Land Acquisition Officer that order sheet is not maintained and that application filed by the applicant is pending.
This Court is of the opinion that before inaction on part of the opposite party in complying with the above direction is treated as wilful disobedience of the order of the Writ Court, one more opportunity be granted to him to ensure compliance of the said order.
Accordingly, the instant contempt application is disposed of with liberty to the applicant to file a certified copy of this order along with fresh representation before the opposite party and in which event, he shall ensure that compliance of the direction issued by the Writ Court is made within next twelve weeks. In case the compliance is still not made, as directed herein, it shall be open to the applicants to initiate fresh contempt proceedings against the opposite party.
