Heard learned counsel for the petitioners and perused the record.
The present petition has been filed for direction upon the court of Additional Civil Judge (Jr. Div.), Court No.1, Jhansi to decide Original Suit No.87 of 2013 (Sanjay and others Vs. Vishal and another) within stipulated period.
From the order-sheet of the case it does not appear that issues have yet been framed. Otherwise also it appears that on the last few dates, the matter was adjourned because the court was lying vacant.
Under the circumstances, this Court finds no good reason to issue any specific direction. However, in case the court is lying vacant since long, it shall be open to the petitioner to apply to the District Judge concern for transfer of the proceeding to another court of competent jurisdiction, which may be available.
With the aforesaid liberty, the petition is disposed off. Order Date :- 24.4.2018.
