The petitioner has not brought on record the agreement so as to gather the terms and conditions of the loan on the strength whereof the recovery has been initiated. We are therefore not inclined to entertain the writ petition. Since the learned counsel for the petitioner is not in possession of the agreement under which the loan has been advanced it is not possible to proceed with the case. Learned counsel for the petitioner prays that he may permitted to withdraw the present writ petition with liberty to file a better writ petition. The writ petition is dismissed as withdrawn with the said liberty.
