Heard learned counsel for the petitioner and learned A.G.A. for the State.
By way of the instant petition, the petitioner has prayed for a direction to the court below i.e. Additional Chief Judicial Magistrate IX, Varanasi in Complaint Case No.900 of 2017 (old number) New Number 1333 of 2018, Sanjay Singh Gautam Vs. Pandit Chotelal Pandey, under Section 138 Negotiable Instruments Act, Police Station Cantt. District Varanasi expeditiously.
In this case, the petitioner happens to be complainant and he wants expeditious disposal of the aforesaid case.
I have considered the submissions advanced by learned counsel for the petitioner and perused the record.
Obviously, the court below is under obligation to expedite the proceeding adhering to the provision of Section 309 Cr.P.C.
In this view of the matter, this petition is disposed of with the direction that the court below will expedite and dispose the aforesaid case in accordance with law expeditiously within a period of four months from the date of production of a certified copy of this order before it after affording opportunity of hearing to the parties concerned if there is no legal impediment.
