The instant application under section 482 Cr.P.C. has been filed for directing the court below to decide the trial of complaint case no. 1780 of 2015 (Sanjay Sharma Vs. Manoj Kumar Singh), under sections 420, 504 IPC, P.S. Civil Lines, District Moradabad, pending in the court of ACJM Court no.5, Moradabad within a stipulated period.
Learned counsel for the applicant-complainant submits that the said complaint was filed on 02./06.2014 and the summoning order was passed on 07.12.2015 but nothing has happened and the matter is still pending before the court concerned. He further submits that in the interest of justice the court concerned may be directed to dispose of the said complaint case within some stipulated period.
In view of the facts and circumstances of the case, the Additional Chief Judicial Magistrate, Court No.5, Moradabad is directed to decide the complaint case no. 1780 of 2015 (Sanjay Sharma Vs. Manoj Kumar Singh), under sections 420, 504 IPC, P.S. Civil Lines, District Moradabad, expeditiously, preferably within a period of six months from the date a certified copy of this order is produced before it.
The application u/s 482 Cr.P.C. is disposed of accordingly.
