Counter affidavit filed on behalf of the State is taken on record.
The petitioner claims the violation of the order dated 14th Nov. 2011 passed by this court in Writ Petition No. 11167 (M.B) of 2011 whereby the arrest of the petitioners in that writ petition(respondents No. 5,6,7 and 8 in this writ petition) was stayed till 22.11.2011 to facilitate them to solemnize the marriage of daughter of petitioner No. 2 of that writ petition, which was to be solemnized on 20.11.2011. The petitioners of the above writ petition also undertook to surrender before the court below on 23.11.2011 but they have not surrendered till date.
Though, on the basis of instructions, learned A.G.A informs that process under section 82 Cr.P.C has also been initiated , but keeping in view the petitioner's undertaking given in the said writ petition , we hereby direct the Superintendent of Police Chhatrapati Sahuji Maharaj Nagar to ensure the arrest of the respondents No. 5,6,7 and 8 in this writ petition forthwith and to produce them before the concerned Magistrate.
In view of the above terms, the writ petition stands disposed of.
