Heard Sri Ravi Agrawal, learned Counsel for the petitioner and learned Standing Counsel.
The petitioner has applied on 11.9.2019 to the District Magistrate, Kanpur Nagar for a character certificate. He wants that the aforesaid application may be considered and decided within a time bound period.
Learned Standing Counsel has pointed out that the District Magistrate certifies the character of a person in accordance with the provision of the Government Order dated 5.1.2007 and, as such where any criminal case is pending or an F.I.R. has been registered against the person concerned, the character certificate, if any, issued to the person concerned is liable to be cancelled, which implicitly means that on the pendency of a criminal case or registration of an F.I.R., a person is not entitled to a character certificate.
Be as it may be, as the petitioner has submitted an application for character certificate, the District Magistrate is obliged to pass final order on it either granging the certificate or refusing the certificate.
Accordingly, we dispose of this petition with the direction to the respondent no.1 to decide the above application of the petitioner in accordance with law, most expeditiously preferably within a period of six weeks from the date of production of certified copy of this order.
