Heard learned counsel for the petitioner Sri Rakesh Kumar and Sri Sudip Seth appearing for opposite-party no.1 State Cadre Authority, Cooperative Bank Centralized Service.
The petitioner is serving in District Cooperative Bank. He was posted from 15th March, 2004 to August, 2007 at Lucknow after which he was transferred to Rae Bareli. On his own request in order to look-after his old father, undergoing treatment at Lucknow, the petitioner was transferred from Rae Bareli to Lucknow on 15.12.2008. Now by the impugned order, the petitioner has been transferred to District Cooperative Bank, Bahraich, giving rise to this petition.
Learned counsel for the petitioner submits that the petitioner's father is a very old and is still under treatment in SGPGI, Lucknow and that the transfer order has been passed to accommodate newly appointed persons.
The petitioner does not have any legally enforceable right to challenge the order on the grounds given in the writ petition. The petitioner holds a transferable post and was posted at Lucknow for looking after his old father for about one year. His transfer to Bahraich would not cause any serious hardship to him.
The writ petition is dismissed.
