Sri Sanjay Kumar Srivastava, learned counsel for the revisionist and Sri Manoj Kumar Dwivedi, learned A.G.A. for the State and perused the material on record.
This revision has been filed to set-aside the interim maintenance order dated 20.03.2021, passed by the Principal Judge, Family Court, Banda passed in Case No. 111/IX/2018, (Anjana Omar Vs. Sanay Omar), by which the concerned has allowed the interim maintenance application moved by opposite party no. 2, under Section 125(2) Cr.P.C., Police Station- Kotwali City, District Banda and revisionist has been directed to pay Rs.5,000/- per month to opposite party no. 2 as maintenance allowance and Rs.2,000/- to the opposite party no. 3 his minor son.
Learned counsel for the revisionist submits that the court below has illegally allowed the application in a routine manner without considering the income of the revisionist. He further submits that the revisionist is a Salesman and is working in the shop of Garments and is earning a very meager amount.
Learned A.G.A. submits that the the amount given by the revisionist to opposite party nos. 2 and 3 is so meager in the present scenario and the maintenance amount is liable to be enhanced.
In view of the above facts and circumstances, no interference is warranted. However, learned counsel for the revisionist prays for and is allowed to pay the remaining amount from the date of order in two installments. The revisionist will pay the first installment on 01.11.2021 and the second installment be paid on or before 24.12.2021.
