Niloufer Akbar, AGA) This writ petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the order dated 27.05.2013 at Ann-A and etc., This writ petition coming on for preliminary hearing in “B” Group this day, the Court made the following:
O R D E R This writ petition is directed against the tender notification dated 27.05.2013 vide Annexure-A and also the re-tender notification dated 23.10.2013 vide Annexure-G.
2. The respondent No.2 has invited tenders under notification dated 27.05.2013. The petitioner has participated in the tender and he was also one of the party in the tender and a successful bidder. The respondent has not issued a work order though he was the successful bidder. Subsequently, the respondents have issued re-tender notification on 23.10.2013 vide Annexure-D. The petitioner has challenged both the impugned orders.
3. Government Advocate has filed a memo dated 01.02.2016 stating that tender dated 27.05.2013 and re-tender dated 23.10.2013 both notifications have been withdrawn.
4. In view of the above said reasons, writ petition does not survive for consideration. If the petitioner has any grievance regarding withdrawal of the tenders, he is at liberty to challenge the same before the appropriate forum.
