Heard learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the respondent.
The petitioner has preferred with the following prayer:-
"[I] direct the Civil Judge (J.D.) Shahar Jaunpur to decide the Case No.368/2009, Tara Devi Vs.Keshav Kumar and others within stipulated period."
It is contended by learned counsel for the petitioner that the petitioner is the defendant in the suit. It is further argued that the matter is pending since 2009, till date no decision has been final taken, he is suffering irreparable loss and prays for expeditious disposal of the same.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (J.D.) Shahar Jaunpur to consider and decide the aforesaid case in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
