Heard Sri S.P.Sharma, learned Counsel for the petitioner, Sri R.N.Kesari, learned Counsel for the respondent-Bank, and Sri Nimai Dass, learned Counsel for the respondents.
On 27.05.2019 following order was passed by this Court:-
"Heard Sri Satya Prakash Sharma, learned counsel for the petitioners and Sri Nimai Dass, learned Addl. Chief Standing Counsel assisted by Sri R.M. Keshari, learned counsel for the respondents-State.
Learned counsel for the petitioners states that the petitioners are ready and willing to deposit the amount in instalments.
Sri Nimai Dass, learned Addl. Chief Standing Counsel appearing for the respondent no.4 has no objection in accepting the amount in easy instalments.
In order to establish their bonafide, the petitioners may deposit 50% of the impugned demand by 31.05.2019. They will produce the receipt of payment before the Court on that date.
Put up as fresh on 31.05.2019. "
Today, on query being made learned Counsel for the petitioner expressed his inability to produce any receipt in compliance of the order dated 27.05.2019.
This Court is not ready to grant any further indulgence to the petitioner as the petitioner has failed to comply with the order passed by this Court on 27.05.2019.
This Writ Petition is dismissed as above. No costs.
However, it is open to the petitioner to take recourse to the other remedies available to him under the law.
