Petitioners claim to be working as Seasonal Collection Peon in the Revenue Department of the State at district Ballia. It is asserted that persons who were engaged much after the petitioners have been regularized with reference to U.P. Collection Peon's Service (Second Amendment) Rules, 2016 but their claim has been overlooked. It is submitted that tentative seniority list was drawn to which petitioners also objected, but without deciding the objections, orders have been passed regularizing the petitioners' junior in employment while overlooking their claim.
Learned Standing Counsel submits that petitioner's grievance shall be examined by the authority competent, in accordance with law, at the first instance.
In the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to approach respondent no.2 by making a representation in respect of their grievance, noticed above, alongwith certified copy of this order, annexing all materials in support of their claim, within a period of three weeks from today. In case such a claim is raised, the same shall be examined by the authority concerned and an appropriate order would be passed, in accordance with law, within a further period of four months thereafter.
