Heard the counsel for the petitioner and the learned Standing Counsel for the State.
It has been stated in the writ petition that the petitioner, who was appointed as Class IV employee in Ramakant Seva Sansthan Madhymik Kanya Vidyalaya Ramakant Nagar, Varanasi is not being paid his salary since March 2013 and is not being allowed to discharge his functions in the Institution by the Head Master of the Institution.
It has been further submitted in the writ petition that the petitioner has made a representation before the District Basic Education Officer, Varanasi for payment of his salary. The representation dated 11.7.2019 has been annexed as Annexure No. 7 to the writ petition.
The Institution is a girls college and it appears from the records annexed with the writ petition that the administration of the Institution has made some complaint against the petitioner for misbehaving with the staff and the students of the Institution and a letter has been written by the Manager of the Committee of the Management of the Institution requesting the District Basic Education Officer, Varanasi to take appropriate action against the petitioner for his activities.
The District Basic Education Officer, Varanasi is directed to decide the representation dated 11.7.2019 submitted by the petitioner within a period of three months from the date a certified copy of this order is produced before him and also to take appropriate action in accordance with law on the grievance of the petitioner as well as on the communication sent by the Manager of the Committee of Management complaining about the alleged misbehaviour by the petitioner with the staff and the students of the Institution.
With the aforesaid directions, the writ petition is disposed of.
