The prayer in this petition is to command the Ghaziabad Development Authority to restrain construction against the layout scheme in Avantika Extension Residents.
On a pointed query by us as to who is raising constructions, the learned counsel for the petitioners submitted that it is the builder who is raising constructions.
The builder has not been impleaded as party respondent.
In view of the above, the learned counsel for the petitioners prays to withdraw this petition with liberty to file a fresh petition by impleading the builder as party respondent.
The petition is dismissed as withdrawn with liberty as prayed for.
