Heard Sri R.K. Ojha, learned Senior Counsel assisted by Sri Shivendu Ojha, learned counsel for petitioner, learned Standing Counsel for respondent no.1 and Sri Shad Khan, Advocate holding brief of Sri Shishir Prakash, learned counsel for respondents no.2 to 5.
The petitioner by means of present writ petition has assailed the transfer order dated 19.06.2021 passed by Director (Personal Management and Administration), UP Rajya Vidyut Utpadan Nigam Limited, Lucknow whereby he has been transferred to Paariksha Project, Jhansi. Pursuant to said transfer order, the petitioner has joined at Jhansi on 14.07.2021.
Learned Senior Counsel has confined his argument only to the prayer that wife of petitioner is posted in office of Accountant General, Prayagraj and, the transfer policy provides that if both spouse are government servants, the endeavour should be made to post them either in same district or nearby district. He further submits that an appropriate direction may be issued to respondent no.3 to consider the grievance of the petitioner.
Considering the aforesaid fact, this Court finds it appropriate to permit the petitioner to submit a fresh representation before the respondent no.3-Managing Director, UP Rajya Vidyut Utpadan Nigam Limited, Lucknow, raising all his grievances against the transfer order within a period of two weeks from today. In case any such representation is filed by petitioner within the aforesaid period, same shall be decided by respondent no.3 within a period of six weeks thereafter.
With the observations made above, the writ petition is disposed of.
