Short counter-affidavit has been filed, which is taken on record.
In compliance of Court's order Basik Shiksha Adhikari, Bahraich, is present in person before this Court.
He says that the he is well aware of the order dated 1.7.2011. The order has not been complied with till date. When the contempt petition was filed and notices for summoning were issued, special appeal has been filed on 27.09.2011 i.e. after two weeks of summons for personal appearance. This cannot be a good ground for taking a defence against them. However, considering the fact that the matter is pending before the Division Bench where special appeal has been filed, this Court allows one month's time to the opposite parties to comply with the Court's order.
List this case on 21.11.2011.
In case the orders are not modified, changed or stayed by the Division Bench and the orders are not complied with by the opposite parties, the Basic Shiksha Adhikari shall appear in person before this Court on the next date of listing to show cause as to why proceedings for committing contempt of this Court should not be initiated against him and why he should not be punished under the Contempt of Court's Act.
