Heard learned counsel for the applicants.
The prayer is for quashing of the proceedings in a complaint case no. 499 of 2010 pending in the Court of Chief Judicial Magistrate, Varanasi (State Vs. Francis Biotech Private Limited and others) under section 18/27 Drugs and Cosmetics Act.
The submission is that the applicant has already resigned from the company as far back in the year 2003 whereas the incident relates to the year 2007. Notice has been accepted by learned AGA, who prays for and is granted four weeks time to file counter affidavit.
Rejoinder affidavit may be filed within three weeks thereafter. List after expiry of aforesaid period.
Till the next date of listing, further proceedings of case no. 499 of 2010 pending before the Chief Judicial Magistrate, Varanasi shall remain stayed. Order Date :- 15.6.2010 yachna
