Heard learned counsel for the petitioners.
The petitioners have filed this writ petition for a direction upon the respondent No.5, District Magistrate, Agra for removing the illegal constructions of the shops raised by respondents No. 7 and 8 over Arazi Nos.98, 99 & 100 situate at Fatehpur Sikri, Tehsil-Kirawali, District Agra.
The petitioners accept that the aforesaid Arazi is not their private land and that it belongs to Rajkiya Bajaj Inter- college.
In view of above, the petitioners are not personally aggrieved by the existence of the said shops over the said land. The petitioners have not filed this writ petition on behalf of Rajkiya Bajaj Inter-college nor on behalf of Committee of Management of the said college. It has not been filed in public interest or in any representative capacity.
In view of above, we do not deem it necessary to intervene in the matter at the behest of those who have no locus standi in the matter.
This apart, the dispute, if any, is of a private nature for which the remedy available to the petitioners is by way of a civil suit.
In view of above, the Writ Petition has no substance and is dismissed.
