Heard learned counsel for the applicant and learned AGA for the State.
By means of this application, the applicant who is involved in case crime no. 303 of 2009, under Sections 364, 302 and 201 IPC, P.S. Rasoolpur, District Firozabad, is seeking enlargement on bail during the trial.
Considering the fact that all the witnesses of fact were examined and It is given to understand by the learned counsel for the applicant that the Investigating Officer of the case is not participating in the trial in S.T. No. 170 of 2009. This is precarious condition and sorry state of affairs. The learned Sessions Judge is directed to take all necessary methods and exercise at the earliest to procure the attendence and early conclusion of the trial.The bail application of the applicant is rejected at this stage.
It is expected from the trial court to conclude the trial latest by 31.12.2018 without granting unnecessary adjournments to either of the parties.
Let copy of this order may be supplied to learned trial court for its compliance by the office of this Court.
