Heard learned counsel for the parties.
Petitioner, a Sub Inspector, Civil Police, came to be suspended on 8 November 2018 under the provisions of U.P Police Officers of Subordinate Rank (Punishment and Appeal) Rules, 1991.
Shri Vijay Gautam, learned Senior Counsel appearing for the petitioner submits that more than six months has passed and no charge sheet has been issued to the petitioner, reliance has been placed on a decision of this Court rendered in Radhey Shyam Singh vs. State of
U.P. and others (Writ-A No. 31104 of 2012) decided on 30 October 2013, to contend that prolonged suspension of the petitioner is clearly unjust and unwarranted. Accordingly, suspension order of the petitioner needs to be revoked.
Learned Standing Counsel submits that the representation of the petitioner shall be considered by the third respondent-Senior Superintendent of Police, Varanasi.
In view thereof, on consent, the petition is disposed of directing the third respondent-Senior Superintendent of Police, Varanasi, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of six weeks from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
