Heard Sri Ramesh Chandra Singh,, learned counsel for the applicant and Sri Mohd Nadeem, learned AGA appearing for the State.
This second bail application moved on behalf of applicant praying to enlarge the applicant on bail in Case Crime No.609 of 2016, under Sections 498-A, 304-B, IPC and Section 3/4 D.P. Act, Police Station Chiluwatal, District Gorakhpur.
This is the third bail application moved on behalf of the applicant. The first two bail applications was rejected on 07.03.2017 and 01.02.2018.
Perusal of record shows that even though the P.W.-2 one of the brother has been declared as hostile, however, the P.W.-1 is presently consistent.
Sri Mohd. Nadeem, leanred AGA appearing for the State has informed the Court that the cause of death is strangulation. The death is within seven years of marriage.
Looking to the aforesaid facts, no case for grant of any indulgence has been made out.
Accordingly, the application for bail is rejected.
