Heard counsel for the petitioner and learned standing counsel for respondents.
Learned counsel for petitioner submits that father of the petitioner, who was a fair price shop dealer, has expired on 21.9.2017. It is further submitted that in terms of Govt. Order dated 17.8.2002, the petitioner is entitled to be appointed as fair price shop dealer in place of his father and in this regard, he has made a representation dated 27.9. 2017 to the District Supply Officer, Gorakhpur but no decision has been taken as yet.
Learned standing counsel submits that appropriate authority in the matter is Sub Divisional Officer, Tehsil Gola, district Gorakhpur, to whom no representation has been made by the petitioner.
After hearing submissions advanced by learned counsel for the parties, the present petition is being finally disposed of by granting liberty to the petitioner to make appropriate application alongwith certified copy of this order before the Sub Divisional Officer, Tehsil Gola, district Gorakhpur within a period of two weeks. In the event any such application is moved by the petitioner, the same shall be considered and decided by the S.D.O., Gola, Gorakhpur in accordance with law expeditiously within one month from the date of receipt of such application.
No order as to costs.
