Heard learned counsel for the petitioner, learned counsel for Gaon Sabha and the learned Standing Counsel.
Present petition has been filed beseeching expeditious disposal of Revision No. C202005000000870 (Om Prakash Tripathi and Others vs. Sanjay Kumar and Others) filed under Section 219 of the U.P. Revenue Code, 2006, pending before the Commissioner, Gorakhpur Division, Gorakhpur (Respondent no. 2).
It is submitted that the present petitioner along with one Om Prakash Tripathi have preferred revision dated 01.10.2020 against the order dated 31.01.2018 passed by the Additional Collector (F & R) in a proceeding under Section 28 of the U.P. Land Revenue Act, which is pending protracted.
Standing Counsel as well as counsel for Gaon Sabha have no objection, if a direction is issued to decide the aforesaid case expeditiously.
In this conspectus as above, no useful purpose would be served to keep this matter pending. Therefore, this court deems it appropriate to finally dispose of the present writ petition, without making any observation on the merits of the case, as mentioned in the writ petition, with a direction to respondent no. 2 to decide the aforesaid revision, strictly in accordance with law by means of a reasoned and speaking order, after affording opportunity of hearing to the parties concerned and without granting any unnecessary adjournments to either of the parties expeditiously, preferably within a period of four months from the date of production of certified copy of this order. It is also provided that in case stay application, filed along with the memo of revision, is pending, the same shall be decided within a month from today, strictly in accordance with law.
With the aforesaid direction, this petition is finally disposed of.
