Heard learned counsel for the accused applicant and the learned AGA and perused the record.
It is contended on behalf of the learned counsel for the accused applicant that in the same incident four person were arrested, out of which two were not send for identification parade and they were enlarged on bail by the learned Lower Court. It is further contended that there are no criminal antecedent against the co accused.
All the facts are not disputed by the leaned counsel for the State.
Without going into the merit of the case at this stage and considering the fact that the offence is triable by the Court of Magistrate. This is the same incident in which the accused is alleged to have been involved with no other criminal antecedent. I think it expedient that the accused be released on bail.
Let the accused applicant Sanjay @ Guddu @ Ravi involved in case Crime No.322 of 2009 under Section 392 411, 341 I.P.C. Police Station Brahmpuri District Meerut be released on bail on his furnishing a personal bond and two sureties each in the like amount to the satisfaction of Court concerned plus following undertaking that:
1. The applicant will not tamper with the evidence during the trial.
2. The applicant will not pressurize/intimidate the prosecution witness.
3. The applicant shall not absent himself from appearing in the Court on the date fixed without prior permission of the Court.
